Welcome to PACIA ("we", "us", or "our"), operated at pacia.app (the "Service"). By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Account Registration
To use the Service, you must create an account using a valid email address or a supported OAuth provider (Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use.
3. Description of Service
PACIA is an AI-powered coaching platform for trail runners and marathoners. The Service provides personalised training plans, post-run analysis, wearable data synchronisation, and adaptive coaching recommendations. The Service is provided for informational and educational purposes only.
4. Health & Fitness Disclaimer
The Service does not provide medical advice. All training plans, coaching recommendations, and analysis outputs are generated by artificial intelligence and are intended for general fitness guidance only. They are not a substitute for professional medical advice, diagnosis, or treatment.
You should consult a qualified healthcare professional before starting any new exercise programme, especially if you have pre-existing health conditions, injuries, or concerns. You assume full responsibility for your use of any training plan or recommendation provided by the Service.
5. AI-Generated Content
Training plans and coaching insights are generated using artificial intelligence. While we strive for accuracy and safety, AI outputs may contain errors or may not be optimal for your specific circumstances. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content.
6. Wearable Data & Third-Party Integrations
The Service integrates with third-party wearable providers (Garmin Connect, Strava) and other services (Google OAuth, Stripe). Your use of these integrations is subject to the respective third-party terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
You may connect or disconnect third-party services at any time from your profile settings. Disconnecting a service will stop future data synchronisation but will not automatically delete previously imported data.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Scrape, crawl, or use automated tools to extract data from the Service
- Impersonate another person or misrepresent your identity
- Share your account credentials with others
- Use the Service to distribute spam, malware, or harmful content
8. Intellectual Property
The Service, including its software, design, logos, and content (excluding user-provided data), is owned by us and protected by intellectual property laws. You retain ownership of your personal data and activity data. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service.
9. Payments & Subscriptions
Certain features of the Service may require a paid subscription. Payment is processed securely through Stripe. Subscription terms, pricing, and renewal policies will be clearly presented before purchase. You may cancel your subscription at any time from your billing settings.
10. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to physical injury, loss of data, or interruption of service.
In particular, we are not liable for any injury, health issue, or adverse outcome resulting from following training plans or recommendations generated by the Service. You use the Service at your own risk.
11. Termination
We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to the Service or other users. You may delete your account at any time from your profile settings. Upon deletion, your data will be handled in accordance with our Privacy Policy.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or by displaying a notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
